‘Completely out of whack’: Media found liable for defamatory Facebook comments
The NSW Supreme Court has found media organisations could be held liable for third-party comments on Facebook.
Former youth detainee Dylan Voller sued three media organisations for allegedly defamatory comments on articles they had posted on their public Facebook pages.
A judge found the organisations could be held liable, even if they didn’t know the comments existed.
Defamation lawyer Matt Collins QC tells Ben Fordham the decision is “completely out of whack with laws in the rest of the world”.
“A media organisation would not be liable for this kind of conduct in the United States or the United Kingdom.
“Australian law has tilted the balance very much in favour of the protection of reputation.”
