One Nation Leader Mark Latham has slammed a major flaw that has been identified within the NSW justice system.

The number of criminal charges being thrown out on the grounds of mental health has skyrocketed.

“We’ve seen a number of high-profile cases dropped as a result of mental health,” Ben said.

Between 2021 and 2022 more than 2,600 defendants had their charges dismissed in local courts on mental health grounds and the charges were for things like stalking, assaulting police,  obscene exposure near a school and animal cruelty.

Mr Latham told Ben Fordham “the system is soft” and the mental illness “excuse” is an “inexact diagnosis”.

“You’ve got ministers there who are encouraging this whole thing to go soft, so there’s the first thing you’d write into the law, you can’t get off on so-called climate anxiety.”
