Strata bodies to be handed more power to block short-term holiday letting
The NSW government is moving to give strata bodies more power in banning short-term holiday letting.
The State Government has revealed proposed laws which will restrict letting through sites like Airbnb to 180 days in cities.
Under the new laws, short term letting can also be banned in unit blocks if it’s not the owner’s primary residence and 75% of the strata body vote against it.
“This change to the by-laws available for strata schemes in New South Wales will empower owners corporations to have more of a say,” Better Regulation Minister Matt Kean tells Ross Greenwood.
If a person defies their own body corporate and continues to let out their property, Mr Kean says they will face the severe consequences.
“If people want to breach… these new laws then there will be significant financial penalties, which will prohibit these platforms from being used for up to five years.”
Home sharing hosts and guests will be subject to a strict two-strike rule, regulations Mr Kean says will be amongst the strictest in the world.
“We will introduce a mandatory code of conduct which hosts, guests and platforms will be required to sign up to.”
The Better Regulation Minister says an independent adjudicator from the Department of Fair Trading will assess alleged breaches of the conduct.
