A prominent constitutional lawyer says the wording of a proposed Indigenous Voice to Parliament, is ‘fatally flawed’.
Australians will be asked whether or not they support enshrining the Voice in the Constitution at a referendum later this year.
The body would provide advice on issues affecting Aboriginal and Torres Strait Islanders, but won’t have veto or spending powers.
Professor Greg Craven has told Ben Fordham, the broadness of the proposed change, could tie up the High Court with legal challenges for years.
“There’s every reasonable proposition that the courts will become involved, in adjudicating representations, whether they’ve been made or listened to.”
