NSW barristers say the backlog of family court cases will only get worse if government push ahead with a planned restructure.

Custody cases will be dealt with under the same system when the Family Court and Federal Circuit Courts are amalgamated next year.

Both courts are currently sorting through a major backlog of cases, with some families forced to wait several years to have their matters resolved.

The NSW Bar Association is pushing against the merger, arguing the new system will only increase delays.

President of the NSW Bar Association Arthur Moses tells Ben Fordham one “swamped” court shouldn’t be combined with another.

They’re floating an alternative which would see the Family Court given more resources to deal with the matters they’re facing.

“There are only 3000 matters pending in that court compared to the 17,000 pending in the Federal Circuit Court,” Mr Moses says.
