Premier promises to block ‘unacceptable’ bail loophole
Dominic Perrottet will meet with the Attorney-General today to close an “unacceptable” loophole allowing judges to grant bail to criminals awaiting sentencing.
Convicted paedophile Neil Duncan has been granted bail for the second time after he was re-arrested at a pony club event for breaking conditions of his bail.
He has been found guilty of eight counts of sexually touching girls aged between 10 and 16 and is awaiting sentencing.
It comes after a second pedophile, Robert van Gestel, was also released on bail to await sentencing.
The NSW Premier told Ray Hadley Justice Robyn Tupman was not acting outside powers available to her when she controversially granted Duncan bail after he was convicted earlier this month, meaning it’s up to state parliament to enact changes.
“I don’t see why between the conviction and the sentencing, that person should be allowed out on bail on any matter – whether it’s a matter of paedophilia or anything else,” he said.
“If that person is facing jail time then certainly, they should not be allowed out between the conviction and the actual sentencing hearing.
“I will be speaking with the Attorney-General later today about working through how we can make changes in an appropriate way to get that outcome.”
