The Australian Electoral Commission explained to Chris O’Keefe the reason why an “X” would not count as a “No” vote during the referendum, but a tick still counts as “Yes”.

Evan Ekin-Smith told Chris ‘X’ not counting is backed up by thirty years of legal advice, as well as following in what the previous two referenda had done. Ekin-Smith urged voters to write simple “Yes” or “No” to avoid any issues with the vote count, and explained the history of “X” not being a valid vote for “No”.

Humorously to Chris, the AEC spokesperson said phrases such as “no way” or “hell yeah” would go up to interpretation to decide whether they would be for or against The Voice.
